1. ACCEPTANCE OF TERMS

By accessing, browsing, or using this Website or purchasing any products offered by Srijitam (“Company”, “we”, “us”, “our”), you (“User”, “you”, “your”) agree to be bound by these Terms and Conditions (“Terms”) and our Privacy Policy, without any qualification or limitation.

These Terms constitute an electronic record under the Information Technology Act, 2000, and the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021, and do not require any physical or digital signatures.

If you do not agree with these Terms, you must not use the Website or any of its services.

 

2. DEFINITIONS

• “Applicable Law” means all statutes, rules, regulations, ordinances, judgments, orders, notifications, and other laws for the time being in force in India.

• “Company” / “We” / “Us” / “Our” refers to Srijitam, its proprietors, officers, employees, and authorized representatives.

• “Products” means all organic and lifestyle products sold on the Website, including soaps, oils, shampoos, and other items as may be added from time to time.

• “Services” refers to the services provided by the Website for browsing, ordering, and purchasing Products.

• “User” / “You” / “Your” includes any person accessing the Website, whether registered or unregistered.

• “Website” means www.srijitam.in and all subdomains thereof.

• “Bulk Order” means any non-personal order negotiated directly with the Company for resale or distribution.

 

3. ELIGIBILITY AND ACCOUNT REGISTRATION

3.1. Only individuals competent to contract under Section 11 of the Indian Contract Act, 1872 (i.e., persons 18 years or older) may use this Website.

3.2. By registering, you confirm that the information you provide is accurate and complete.

3.3. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

3.4. The Company reserves the right to deny, suspend, or terminate access to any User or account at its sole discretion, without prior notice, for any reason including violation of these Terms or Applicable Laws.

4. PRODUCTS

4.1. The Website facilitates the online purchase of organic products manufactured and/or marketed by the Company.

4.2. Product availability, specifications, descriptions, and prices are subject to change without prior notice.

4.3. All Products are listed on an “as available” basis.

4.4. Products are intended for personal use only and not for resale or bulk commercial use.

4.5. The Company reserves the right to cancel any Bulk Order or any transaction it believes violates these Terms.

 

5. PAYMENTS

5.1. All prices on the Website are in Indian Rupees (INR) and inclusive of applicable taxes.

5.2. Payments can be made via credit/debit cards, net banking, UPI, or cash on delivery (COD), subject to availability.

5.3. COD orders may attract a nominal logistics charge in addition to product price.

5.4. Transactions are processed through secure third-party payment gateways. The Company shall not be liable for any payment failure, delay, or data breach occurring on such third-party systems.

5.5. Prices are subject to change at any time at the Company’s sole discretion.

 

6. SHIPPING AND DELIVERY

6.1. Shipping is available across India through approved logistics partners.

6.2. Delivery timelines vary depending on the delivery address and product availability.

6.3. Delivery charges will be displayed at checkout.

6.4. The Company follows a no return policy, except in the following cases:

• Damaged products in transit;

• Products past expiry at the time of delivery; or

• Wrong product delivered.

In such cases, replacement shall be offered upon verification.

6.5. Users must inspect the package upon delivery and notify the Company immediately of any issues.

6.6. The Company shall not be liable for any delay due to circumstances beyond its control (e.g., strikes, natural disasters, courier delays).

 

7. INTELLECTUAL PROPERTY

7.1. All intellectual property rights, including trademarks, designs, text, content, graphics, and software on the Website, are the exclusive property of Srijitam.

10. LIMITATION OF LIABILITY

10.1. Under no circumstances shall the Company or its representatives be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or goodwill.

10.2. The Company’s total liability, if any, for all claims arising from use of the Website or Products shall not exceed Rs. 200.

10.3. The Company shall not be responsible for any technical or service interruptions, including payment or network failures.

11. GOVERNING LAW AND DISPUTE RESOLUTION

11.1. These Terms shall be governed by and construed in accordance with the laws of India.

11.2. The courts at Gurugram, Haryana shall have exclusive jurisdiction.

11.3. Any disputes shall be resolved by arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator appointed jointly by the parties.

11.4. The arbitration shall be conducted in English and seated in Gurugram, Haryana.

11.5. The arbitral award shall be final and binding on both parties.

 

12. MODIFICATIONS

The Company reserves the right to modify, amend, or update any part of the Website or these Terms at any time without prior notice. Continued use of the Website constitutes acceptance of the revised Terms.

 

13. COMMUNICATION AND UNSUBSCRIPTION

13.1. By registering or transacting on the Website, you consent to receive communications (through SMS, email, WhatsApp, or calls) regarding orders, offers, and updates from Srijitam or its authorized third-party communication providers, even if your number is on the DND list.

13.2. You may opt out of promotional messages anytime by following the “unsubscribe” instructions provided in such communications.

 

14. MISCELLANEOUS

14.1. If any provision of these Terms is held invalid, the remainder shall continue in full force and effect.

14.2. No waiver by the Company shall constitute a continuing waiver of rights.

14.3. Nothing herein shall create a partnership or joint venture between the User and the Company.

14.4. The Company may assign its rights and obligations to any successor or affiliate without notice to the User.

14.5. User account details (email, phone number, etc.) may be used solely to assist in transactions, delivery, and post-sale support.
